Flexible Employment Contract

All employment contracts, whether they are based on an award or not, must cover National Employment Standards. Flexible employment contracts offer you some flexibility in the employment terms and conditions as long as you can  demonstrate that the employee will be better off over-all as a result of the bargain you strike.

An ‘Individual Flexibility Agreement’ is an employment contract between a single employer and employee that modifies the application of a modern award or enterprise agreement. The individual flexibility agreement must satisfy the better off overall test. There is no requirement to register an individual flexibility agreement.
